This agreement between Julieann Wright (Stardusted Bengals) and the buyer,________________________.
1.) Buyer agrees and binds him/herself to take good and reasonable care of this kitten/cat so as to provide appropriate food, shelter, correct routine and accident related medical care, training, exercise and affection. It is agreed that this kitten/cat will not be allowed outside off leash without an adequate enclosure. IF KITTEN/CAT IS LOST OR STOLEN FOR ANY AMOUNT OF TIME, CONTRACT IS NULL AND VOID. Abuse, neglect, or lack of adequate care will result in Buyer relinquishing kitten/cat to breeder unconditionally with no compensation. If shipping is needed it will be at the Buyer's expense. Buyer agrees to never sell, rent, loan or give away kitten/cat to any organization(s) including, but not limited to, animal shelters or testing facilities. The animal is not to ever go to a shelter! If a need for re-homing should arise, buyer agrees to notify the seller promptly when the animal changes possession. Buyer will assist in the re-homing of said pet if requested and if a suitable home can not be found, buyer will take back said pet. ANIMAL IS NOT TO BE EUTHANISED! This contract is NOT transferable.
2.) SAID KITTEN/CAT MUST REMAIN ON THE SUGGESTED RAW DIET FOR A MINIMUM OF TWO WEEKS AFTER DELIVERY BEFORE SWITCHING TO ANOTHER DIET. WHEN SWITCHING THE DIET, IT MUST BE DONE GRADUALLY TO ALLOW KITTEN/CAT ADEQUATE TIME TO ADJUST. IF BUYER FAILS TO DO EITHER, THIS CONTRACT WILL BE NULL AND VOID.
3.) BUYER AGREES TO NEVER VACCINATE OR DEWORM THE KITTEN/CAT WHILE SICK BECAUSE IT MAY CAUSE DEATH. IF BUYER FAILS TO HEED THIS, CONTRACT WILL BE NULL AND VOID.
4.) Kittens are not guaranteed against accidental death or injury at any time after sale. The guarantee is null and void if the kitten/cat is not isolated for a period of no less then 3 days (14 days is recommended) and the kitten/cat must be examined by your veterinarian within 72 hours from purchase date, so you are both confident that the kitten is completely healthy. Breeder cannot be responsible for contagious diseases or illness the kitten is exposed to during shipping that are not evident during the initial guarantee period. No refunds will be given after 72 hours. If the kitten goes into a multi-pet family, it is the responsibility of the buyer to have complete blood profiles done and the results sent to Seller, before kitten can be returned. The cost of this testing will be at buyer's expense. If sickness is found, a second licensed vet’s opinion may be required at Breeder’s discretion. Kittens are not guaranteed to be hypo allergenic - please test for allergies before getting a kitten if you are unsure.
5.) Said kitten/cat is further guaranteed to be free from congenital defects or genetic diseases for a period of 2 years from date of sale. In the event that this kitten is found to have a congenital defect or genetic disease where euthanasia is considered to be necessary or imminent, a replacement kitten will be given. NO KITTEN OR CAT IS TO BE EUTHANISED WITHOUT THE PRIOR KNOWLEDGE OF THE BREEDER, EXCEPT IN THE CASE WHERE A VETERINARIAN CONSIDERS IT THE ONLY HUMANE ALTERNATIVE, OR THE GUARANTEE IS VOID. An autopsy is required to confirm a medical diagnosis in this case.
If a pet is diagnosed with a minor imperfection (not known at time of sale) that requires no treatment and does not interfere with the normal function and purpose of the kitten/cat as an active pet, then no credit will be given.
Where a replacement is requested and where euthanasia is necessary, buyer agrees to grant full access to ALL veterinary records to Breeder. Veterinary records include copies of actual visit cards to veterinarians stating vaccinations, injuries, test results, costs, etc. during the period the kitten is owned by the Buyer. No replacement will be given for any condition or defect caused by accident, neglect, poisoning, malnutrition, or dehydration. Buyer is responsible to provide immediate veterinary care to any kitten/cat showing signs of illness or distress. Failure to do so will render this guarantee null and void.
No replacement will be given for any congenital defect or disease that was made known to the buyer by the seller BEFORE final purchase of the kitten/cat. In this case the buyer has the option to either purchase kitten "as is" or not purchase the kitten/cat at all. BREEDER ASSUMES NO LIABILITY FOR VETERINARY COSTS OR OTHER EXPENSES INCURRED BY THE OWNER. BUYER ACKNOWLEDGES THAT BREEDERS LIABILITY CAN NEVER EXCEED WHAT IS EXPRESSED IN THIS GUARANTEE AND AGREEMENT AND IS LIMITED TO PHYSICAL REPLACEMENT OF KITTEN/CAT.
6.) SELLER WILL WITHHOLD PAPERS UNTIL PROOF THAT THE KITTEN HAS BEEN SPAYED/NEUTERED AT SIX MONTHS OF AGE HAS BEEN GIVEN TO SELLER. IF KITTEN SOLD IS OF BREEDING/SHOW QUALITY BUYER HAS THE OPTION TO PAY AN EXTRA FEE (AMOUNT DESIDED BY SELLER) FOR BREEDING RIGHTS IF DESIRED. IF SAID DISCISION IS MADE SELLER MUST BE INFORMED PRIOR TO SAID PUPPY TURNING SIX MONTHS OF AGE AND BUYER MUST AGREE TO AND SIGN A NEW CONTRACT TO OBTAIN PAPERS WITH FULL RIGHTS.
IF SAID KITTEN IS NOT OF BREEDING OR SHOW QUALITY OR A FEE FOR BREEDING RIGHTS IS NOT PAYED TO SELLER, SAID KITTEN IS NOT TO BE USED FOR BREEDING! IN THIS CASE, IF IT IS DISCOVERED THAT SAID KITTEN/CAT HAS BEEN USED FOR BREEDING, Stardusted Bengals WILL PURSUE IN COURT FOR AN AMOUNT OF $3,000 AND SAID PET AND ALL OFFSPRING MUST BE RELINQUISHED TO SELLER ALONG WITH ALL HEALTH RECORDS AND PAPERS AT THE BUYERS EXPENSE! NOT TO BE USED FOR BREEDING UNLESS SAID KITTEN/CAT IS OF PROPER QUALITY AND AN EXTRA FEE IS PAID TO THE SELLER FOR BREEDING RIGHTS.
7.) Replacement kitten to be of same quality as originally purchased unless other arrangements are made between the two parties. A replacement kitten to be granted within 12 months from purchase date. A replacement kitten will only be given granted that the kitten it is replacing has been returned, if alive, and proof of veterinary analysis of condition is given. If kitten to be replaced is deceased, an autopsy at the expense of the buyer must be done and results given to Stardusted Bengals.
8.) No habit is guaranteed for or against. Any habit, good or bad, can be made or broken, so we do not guarantee this. Please be sure to read and understand this Agreement before signing. If you have any questions, please ask before signing this agreement. This Contract is legally binding to all parties involved. It applies only to the buyer and Stardusted Bengals (Julieann Wright) in this transaction and is non-transferable to other parties.
